PRIVACY NOTICE
pursuant to Art. 13 of Regulation (EU) 2016/679
In accordance with article 13 of Regulation (EU) 2016/679 (hereinafter “GDPR 2016/679”), and subsequent amendments, laying down rules on the protection of persons and other subjects with regard to the processing of personal data, you are hereby informed that the personal data you provide will be processed in compliance with the aforementioned legislation and with the confidentiality obligations required by law.
Please note the following information:
– Processor and Controller: the Controller is COMEC ITALIA SRL (VAT number 02143650121), with registered office in Cavaria Con Premezzo (VA), Piazzale del Lavoro 149, represented by Mr. Manuele Baggini.
– purposes of the processing: the personal data you provide is necessary for the performance of Comec Italia srl’s activities, as well as for compliance with legal obligations;
– provision of data, refusal and withdrawal: the provision of your personal data is required to carry out the activities referred to above and your refusal (or withdrawal of consent) to the processing will make it impossible to carry out all activities concerning you;
– processing and storage methods: processing will be carried out using physical (hard copy) and digital (computerized) methods, in compliance with the provisions of Article 32 of GDPR 2016/679 on security measures, by the Controller and/or specially appointed persons and in compliance with the provisions of Article 29 GDPR 2016/679; in compliance with the principles of lawfulness, purpose limitation and data minimisation, in accordance with Art. 5 GDPR 2016/679, subject to your freely given explicit consent at the end of this privacy notice, your personal data will be processed and stored for the time necessary to achieve the purposes for which they are provided and, in any case, for the period of time required by law;
– scope of disclosure and dissemination: the data collected will not be disseminated or disclosed without your explicit consent, except for necessary disclosure that may involve the transfer of data to public bodies (e.g. legal authorities, etc.) or to private parties for the fulfilment of obligations arising from the activity carried out and the law;
– transfer of your personal data: your data will not be transferred to Member States of the European Union or to third countries outside the European Union; should the need arise, the Controller will ask you to give your explicit consent;
– special categories of personal data: in accordance with articles 9 and 10 of Regulation (EU) 2016/679, you could be asked to provide “special categories of personal data” (previously known as “sensitive data”). This is data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, as well as genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or a natural person’s sex life or sexual orientation, data concerning criminal convictions, offences or security measures. These data may only be processed after you have freely given your explicit consent in writing at the end of this privacy notice;
– your rights: you may exercise at any time, pursuant to Articles 15 to 22 of Regulation (EU) 2016/679, your right to:
- a) request confirmation as to whether or not personal data concerning you are being processed;
- b) obtain information regarding the purposes of the processing, the categories of personal data concerned, the recipients or categories of recipient to whom the personal data have been or will be disclosed and where possible, the period for which the personal data will be stored;
- c) obtain the rectification or erasure of your data;
- d) obtain the restriction of processing;
- e) obtain data portability, that is receive the data from the controller in a structured, commonly used and machine-readable format, and transmit those data to another controller without any hindrances;
- f) object at any time to processing of your personal data including processing for direct marketing purposes;
- g) object to decisions based on automated processing relating to natural persons, including profiling;
- h) ask the controller for access to your personal data being processed and rectification or erasure of these data or restriction of processing of personal data concerning you, including the right to data portability;
- i) withdraw your consent at any time (even though withdrawal will make the continuation of the professional relationship impossible), without affecting the lawfulness of processing based on your consent before its withdrawal;
- j) lodge a complaint with a supervisory authority.
The rights referred to in points (a) to (i) may be exercised by means of a written request sent to the Controller, as shown above, at Comec Italia srl.
